Welcome to The Carolina Cradle. These Terms and Conditions govern your use of our website and services. By accessing our site, viewing our content, or booking our services, you agree to be bound by these terms. The Carolina Cradle is a photography business based in Summerville, South Carolina.
2. Intellectual Property and Copyright
2.1. All content on this website, including but not limited to photographs, text, graphics, logos, and digital downloads, is the exclusive property of The Carolina Cradle and is protected by copyright and other intellectual property laws.
2.2. The copyright for all photographs produced by The Carolina Cradle remains with The Carolina Cradle. Clients are granted a limited license for personal use only unless otherwise specified in a separate photography agreement.
2.3. Unauthorized use, copying, reproduction, distribution, or modification of any website content or photographs without the express written permission of The Carolina Cradle is strictly prohibited and may result in legal action.
3. Permitted Use of Website and Content
3.1. You are permitted to view, download, and print content from this website for your own personal, non-commercial use, provided that you do not modify the content and that all copyright and proprietary notices are retained.
3.2. You may share images on social media, provided that proper credit is given to The Carolina Cradle. Removing watermarks or altering images in any way is not permitted.
4. Booking, Payments, and Cancellations
4.1. Booking & Retainers: A non-refundable retainer fee is required to secure your booking date and time. The retainer covers administrative work and holds your date, preventing other clients from booking.
4.2. Payment: The remaining balance for services is due on or before the date of the photography session or event. Failure to make timely payments may result in the cancellation of your booking.
4.3. Client Cancellations: If you must cancel your session, please provide written notice.
* Prior to 24 hours before the session: Any payments made beyond the non-refundable retainer may be refunded.
* Less than 24 hours before the session: The retainer and any other payments made are non-refundable.
4.4. Rescheduling: Rescheduling requests are subject to the photographer's availability. Depending on the timing, a rescheduling fee may apply.
4.5. Photographer Cancellation: In the unlikely event that The Carolina Cradle must cancel your session due to unforeseen circumstances (e.g., illness, equipment malfunction, weather), we will make every effort to reschedule or provide a full refund of all monies paid.
5. Limitation of Liability
5.1. The Carolina Cradle takes the utmost care with respect to the production, processing, and delivery of photographs. However, in the unlikely event that photographs are lost, stolen, or destroyed for reasons beyond our control, our liability is limited to a full refund of all payments received for the session.
5.2. The Carolina Cradle is not liable for any injuries, damages, or losses that occur during a photography session. You agree to enter the session at your own risk and to be responsible for the conduct and safety of yourself and any accompanying guests.
6. Privacy Policy

7. Governing Law
These Terms and Conditions are governed by the laws of the state of South Carolina. Any disputes related to these terms will be subject to the exclusive jurisdiction of the courts located in Summerville, South Carolina.
